What DA Form Is a Sworn Statement?

    Purpose

    • According to the Army, the purpose of the form is to allow officers and non-commissioned officers to maintain discipline and enforce military law by facilitating the collection of official statement of soldiers where criminal activity may be involved.

    Alternative Uses

    • Military officials often use DA Form 2823 in noncriminal matters, as well, such as in investigating reports of survey on lost equipment or documenting the circumstances of a detainee's capture.

    Considerations

    • In addition to the signature of the soldier providing the sworn statement, DA Form 2823 also requires the signature of a witness and at least one commissioned officer. When investigating criminal procedures, officials frequently have the soldier giving a sworn statement sign DA Form 3881, the Rights Warning Procedure/Waiver Certificate.
